Management of our obligations towards our customers

Payment collection and fraud prevention

We process your Data in order to recover unpaid amounts and to combat fraud. This processing has the following sub-purposes: (i) securing payments, (ii) detecting and preventing fraud, and (iii) managing debt collection.

The performance of the contract between you and Pneurama, acting as data controller, is the legal basis for this processing.

Management of Pneurama’s advertising operations

We process your Data to manage Pneurama’s advertising operations. The sub-purposes of this processing are: (i) managing technical prospecting operations, (ii) selecting individuals to participate in studies following advertising campaigns, (iii) conducting solicitation activities, (iv) preparing commercial statistics, (v) prospecting customer and prospect databases by us or by partners, (vi) updating prospect databases by the body responsible for managing the telephone marketing opt-out list, (vii) organizing contests, lotteries or any promotional operations excluding online gambling and games of chance, and (viii) enriching customer and prospect databases.

The legal basis for this processing is your consent.

Communication with you

We collect and retain your personal information in order to communicate with you regarding your orders, invoices, or complaints submitted to customer service.

The performance of the contract between you and Pneurama, acting as data controller, is the legal basis for this processing.

Improving your customer experience

We analyze your personal information to improve your customer experience. Unless you object, these analyses allow us to offer you innovative products or complementary or promotional offers, or to display advertisements that correspond, as far as possible, to your consumption habits and areas of interest.

Targeted partner advertising

Pneurama collects and analyzes your data for marketing purposes (profiling), with the assistance of specialized service providers. In this context, your personal data may be:

  • Transformed into detailed pseudonymized profiles (i.e., profiles that no longer allow you to be personally identified when advertising content is displayed during your browsing on the Internet) to be used by our brands and commercial partners to carry out targeted online advertising campaigns (display) based on your interests and to provide you with offers that match your consumption habits.

  • Used by Pneurama or transmitted to our service providers in order to offer you advertisements directly by mail or telephone calls (by tele-advisors and not by automated calling systems).

  • From your personal account, go to the 'My alerts' section and click on 'I do not wish to receive relevant advertising'.
  • On your mobile device, enable the 'Limit Ad Tracking' setting in your iOS phone settings or the setting that disables personalized ads on your Android phone.

Legal or regulatory requirements

We may be required to disclose your personal data in response to legitimate requests from public authorities, including to meet national security requirements, combat fraud, or comply with the law.

Supplier file management

Your data may be transmitted to:

  • staff in charge of purchasing, administrative and accounting departments, their hierarchical superiors, and persons contractually linked to the company or organization to ensure its accounting;
  • persons responsible for audits (statutory auditors, chartered accountants, internal control departments);
  • external companies contractually bound for the performance of the contract;

Who are the recipients of your personal data?

We ensure that only duly authorized persons within Pneurama have access to your personal data when such access is necessary for the performance of our business relationship.

Our service providers and targeted advertising partners may also receive personal data strictly necessary for carrying out the services entrusted to them (for example: delivery of your purchases, online payment processing, targeted promotional campaigns).

Where is your personal data stored?

The data are hosted in Morocco or in countries offering an equivalent level of protection recognized by the CNDP. Any transfer outside Morocco is subject to authorization from the CNDP.

We may share personal data necessary for the implementation of the services you have contracted or subscribed to with other companies (examples: home delivery, pickup point, product availability alerts). Any operations with a service provider receiving your data are governed by a contract to ensure the protection of your data and respect for your rights.

If our service provider operates outside the European Union, we protect the confidentiality of your personal information and your rights by using the data protection clauses recommended by the European Commission.

  • Right to erasure of your data: Subject to legal exceptions, you may request from Pneurama the erasure of your data without undue delay, in particular if you consider that the processing carried out by Pneurama is no longer necessary in relation to the purposes for which the data were collected.
  • Right to data portability: You have the possibility to retrieve part of your data in an open and machine-readable format or to request that Pneurama transmit them to another organization. This right only applies to data that you have actively and knowingly provided to Pneurama (for example, data entered in an online form) or data generated through the use of a service or device in the context of entering into or managing your contract, and which are processed automatically on the basis of your consent or the performance of a contract.
  • Right to object: You may object to your data being used by an organization for a specific purpose. You must then provide reasons relating to your particular situation, except in the case of commercial prospecting, to which you may object without giving any reason.
  • Right to restriction of processing: You may request that Pneurama retain your data without using them in one of the following cases: you contest the accuracy of the data used by Pneurama; you object to the processing of your data; in case of unlawful use but you oppose their erasure; or you need them for the establishment, exercise, or defense of legal claims.
  • Right to withdraw your consent: Where the processing of your personal data is based on your consent (for example, the sending of electronic commercial offers), you may withdraw your consent at any time. Likewise, to withdraw your consent to cookies, you may do so in accordance with the procedures mentioned in Article 3 of this policy.
  • Right to provide post-mortem instructions: You have the possibility to define instructions regarding the retention, erasure, and disclosure of your data after your death. These instructions determine how you wish your rights over your data to be exercised after your death. You may send these instructions to Pneurama’s DPO by mail, indicating in the subject line “Post-mortem instructions”. You may modify or revoke your instructions at any time.
  • Right to lodge a complaint with the CNDP: If you believe that your rights are not respected or that the protection of your data is not ensured in accordance with Law No. 09-08, you may at any time lodge a complaint with the competent supervisory authority, namely the CNDP (https://www.cndp.ma).

Our security and confidentiality commitments

Respecting your right to the protection, security, and confidentiality of your data is our priority.

Pneurama implements organizational and technical security measures appropriate to the level of sensitivity of personal data in order to protect them against any malicious intrusion, loss, alteration, or disclosure to unauthorized third parties.

When developing, designing, selecting, and using our services that rely on the processing of personal data, Pneurama takes into account the right to personal data protection from the outset.

In this respect, for example, we carry out pseudonymization or anonymization of personal data whenever possible or necessary.

As all personal data are confidential, access is limited to Pneurama employees or service providers acting on behalf of Pneurama who need them to perform their duties. All persons with access to your data are bound by a duty of confidentiality and are subject to disciplinary measures and/or other sanctions if they fail to comply with these obligations.

Operations involving a third-party recipient are governed by a contract to ensure the protection of your personal data and respect for your rights.
